Senator Shelley Moore Capito has expressed her support for West Virginia’s Save Women’s Sports Act as the Supreme Court prepares to hear arguments regarding the law. The act, enacted in 2021, is at the center of a legal debate about participation in women’s sports.

On January 12, 2026, Capito posted: “Tomorrow, the Supreme Court will hear arguments on West Virginia’s Save Women’s Sports Act. The Save Women’s Sports Act, which was signed into law in WV in 2021, is commonsense legislation that protects women and girls by ensuring they are not forced to unfairly compete against”.

The following day, she wished success to those defending the law before the Supreme Court: “Good luck to West Virginia Attorney General McCuskey, Solicitor General Williams, and the entire team arguing before the Supreme Court today in defense of the Save Women’s Sports Act. We are all cheering you on as you defend commonsense and West Virginia values on the national” (January 13, 2026).

Later that day, Capito reiterated her position: “Let’s be clear: forcing women to compete against biological men for a misguided attempt at “fairness” is anything but fair. I am proud to be a leading defender of women’s athletics in the United States Senate and I will continue to fight to ensure that female athletes of all” (January 13, 2026).

The Save Women’s Sports Act prohibits transgender girls and women from participating on female sports teams at public secondary schools and colleges in West Virginia. This legislation has faced legal challenges over its compliance with federal anti-discrimination laws.

Shelley Moore Capito serves as U.S. Senator for West Virginia and has consistently supported policies she says protect women’s athletics.
