Today, the Supreme Court of the United States issued a unanimous decision in the case of Seven County Infrastructure Coalition v. Eagle County, which tightens requirements under the National Environmental Policy Act (NEPA). U.S. Senator Shelley Moore Capito, Chairman of the Senate Environment and Public Works Committee, expressed approval of this ruling.
Senator Capito has been an advocate for narrowing NEPA reviews to reduce delays in infrastructure projects. She participated in an amicus brief opposing the expansion of NEPA, alongside Senators John Barrasso, Mitch McConnell, Mike Lee, Mitt Romney, and Ted Cruz.
“Today’s unanimous decision by the Supreme Court of the United States validates what my colleagues and I have long been saying,” stated Senator Capito. She emphasized that NEPA obligations have been misused to hinder projects rather than protect the environment. The decision aims to streamline project approvals by focusing on actual impacts rather than hypothetical scenarios.
The ruling is expected to expedite infrastructure initiatives such as pipelines and roads by limiting lower courts’ scope in reviewing NEPA documents. Senator Capito highlighted that this is a significant step for permitting reform, particularly benefiting states like West Virginia by reducing litigation and delays.
